1. INTRODUCTION These Terms and Conditions (“Terms”) govern your booking with “TOUR KYIV” LLC (ТОВАРИСТВО З ОБМЕЖЕНОЮ ВІДПОВІДАЛЬНІСТЮ “ТУР КИЇВ”), a company registered in Ukraine (Registration Code: 45574595), with its registered office at: 04112, Kyiv, Parkovo-Syretska St, 12A, Office 2.

By booking a tour with us, you agree to these Terms in full.

2. BOOKING AND PAYMENTS

• Pricing: Prices are listed in multiple currencies (e.g., GBP, EUR, USD). The final charge will be processed based on the currency selected at checkout.
• Deposit: A non-refundable deposit of 15% of the total tour price is required to secure your booking.
• Balance Payment: The remaining balance is due 28 days before the tour start date, or immediately if booking within that period.
• Insurance: We do not provide travel or medical insurance. It is your sole responsibility to ensure you have adequate insurance coverage that specifically includes travel to Ukraine (a conflict zone) if you wish to be covered. We do not check your insurance status.

3. WAR RISK ACKNOWLEDGEMENT & LIABILITY WAIVER

• Acknowledgement of Danger: You acknowledge that Ukraine is currently in a state of active military conflict/war. You understand that participation in our tours may involve extreme risks, including but not limited to: missile and drone attacks, artillery shelling, landmines, unexploded ordnance, military checkpoints, and air raid sirens.
• Assumption of Risk: You voluntarily assume all risks associated with travelling to and within Ukraine. You agree that “TOUR KYIV” LLC, its directors, guides, drivers, and contractors are not liable for any injury, death, trauma (physical or psychological), or loss of property resulting from acts of war, military operations, or terrorism.
• Medical & Consular Limitations: You acknowledge that medical services and consular assistance from your home country may be limited or unavailable in Ukraine.

4. CANCELLATION AND CHANGES BY YOU

• Changes: You may change your tour dates or details for free up to 28 days prior to the scheduled start date.
• Cancellations:
  • More than 28 days notice: We will refund any payments made, less the 15% non-refundable deposit.
  • Less than 28 days notice: Cancellations made within 28 days of the trip are non-refundable.
  • No-Shows: Failure to arrive for the tour results in a 100% forfeiture of payment.

5. CANCELLATION AND CHANGES BY US (FORCE MAJEURE)

• Operational Philosophy: We are experienced professionals and our intent is always to ensure the tour goes ahead. However, plans may change due to safety.
• Force Majeure: We are not liable for changes or cancellations caused by events beyond our control, including “Acts of God,” new martial law decrees, curfews, air raids, or severe security alerts.
• Adjustments: In the event of such disruptions, we reserve the right to:
  • Alter the itinerary, route, or timing of the tour to ensure safety.
  • Reschedule the tour to a later date.
  • Note: If we must significantly alter or reschedule a tour for safety/war-related reasons, you are not automatically entitled to a refund. We will work with you to find a suitable alternative.

6. GUEST CONDUCT AND SAFETY

• Authority of the Guide: The decision of the tour guide/driver is final on all matters likely to affect the safety or well-being of any person participating in the trip.
• Photography Rules: You must strictly adhere to instructions regarding photography. Photography of military checkpoints, soldiers, strategic infrastructure, or equipment is strictly prohibited.
• Termination of Tour: If you fail to comply with a decision made by a guide, or interfere with the well-being or mobility of the group (including disrespectful behavior toward locals or staff), the guide may direct you to leave the tour immediately, with no right of refund.
• Illegal Acts: Any guest found breaking Ukrainian law will be reported to the relevant authorities immediately.

7. GOVERNING LAW These Terms are governed by the laws of Ukraine. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Ukraine.

PUBLIC OFFER AGREEMENT

Kyiv, Ukraine

1. GENERAL PROVISIONS

1.1. This Public Offer (hereinafter referred to as the “Agreement”) is an official public offer of “TOUR KYIV” LIMITED LIABILITY COMPANY (hereinafter referred to as the “Contractor”), acting on the basis of the Charter, to any individual or legal entity (hereinafter referred to as the “Customer”), to conclude a Service Agreement on the conditions specified below.

1.2. Acceptance of this Offer is the complete and unconditional acceptance by the Customer of all the terms of this Agreement.

2. SUBJECT OF THE AGREEMENT

2.1. The Contractor undertakes to provide services to the Customer according to the Contractor’s registered economic activities, specifically:

• Other passenger land transport (Main);
• Passenger land transport (urban and suburban);
• Renting and leasing of cars and light motor vehicles;
• Travel agency and tour operator activities;
• Other reservation service and related activities;
• Technical maintenance and repair of motor vehicles.

2.2. Specific details of the services, routes, rental terms, or tour packages are determined in the specific order, invoice, or ticket issued to the Customer.

3. RIGHTS AND OBLIGATIONS

3.1. The Contractor is obliged to:

• Provide services in a timely and high-quality manner.
• Ensure the safety of passengers and cargo during transport services.

3.2. The Customer is obliged to:

• Pay for the services in the amount and manner prescribed by this Agreement.
• Provide accurate information required for the provision of services (booking details, documents).
• Adhere to the rules of conduct during transportation or vehicle rental.

4. COST OF SERVICES AND PAYMENT

4.1. The cost of services is determined by the Contractor’s current tariffs regarding the specific type of service (transport, rental, or tour) requested by the Customer.

4.2. Payment is made in national currency (UAH) or other currencies as permitted by law, via bank transfer or other payment methods accepted by the Contractor.

5. LIABILITY OF THE PARTIES

5.1. For non-performance or improper performance of obligations under this Agreement, the parties shall be liable in accordance with the current legislation of Ukraine.
